I. Introduction and Purpose
Mission Statement: FLIVID LLC [JWCAB, @JWigglesCAB, jwigglescab.com, flividjwcab] ("the Company," "we," "us," or "our") is committed to building a vibrant, accessible, and trustworthy collecting experience. We believe the joy of collecting is rooted in fairness, integrity, and transparency.
Scope: This policy serves as the code of ethics for all employees, management, board members, contractors, and third-party suppliers ("Company Representatives"). Adherence to this policy is a condition of employment/engagement and a condition of use of our website and purchase of our products.
Commitment: The Company is dedicated to upholding the highest standards of ethical conduct, ensuring compliance with all applicable federal, state, and local laws and regulations within the State of Ohio and all other relevant jurisdictions.
II. Product Sourcing and Integrity
The foundation of our business is the quality and provenance of our products.
A. Authenticity Verification:
All trading cards sourced for repackaging must be authentic products from legitimate manufacturers. Counterfeit, replica, or otherwise fraudulent products are strictly prohibited. The Company employs a multi-point verification process to confirm authenticity and provenance of all bulk purchases.
B. Ethical Sourcing & Supplier Due Diligence:
We require all suppliers to adhere to legal and ethical standards in their business operations. This includes strict prohibitions on child labor, human trafficking, forced labor, and unsafe working conditions. The Company reserves the right to audit supplier practices.
C. Prevention of Unfair Advantage (Anti-Scanning):
To ensure a level playing field for all customers, the use of any technology, technique (e.g., weighing, measuring, or using specific apps/devices), or method to pre-determine the contents of sealed products prior to our internal processing is strictly forbidden. The integrity of sealed source material must be maintained until the point of our internal sorting/repackaging process.
III. Repackaging and Curation Process
Our internal processes are designed to ensure every customer has a fair and genuine chance of obtaining valuable cards.
A. Fairness in Collation and Randomization:
Repackaged products will be collated using methods designed to ensure true randomization and fair distribution of different tiers of cards (e.g., commons, uncommons, rares, foils, inserts). We explicitly avoid manipulative practices that concentrate high-value items in specific batches to create artificial scarcity or false advertising claims.
B. Clear Disclosures and Packaging Transparency:
All packaging and related marketing materials will clearly identify the nature of the product as a "Repackaged Assortment" or "Curated Mystery Box." Disclosures will include:
- The range or variety of cards that may be included.
- The actual odds of pulling specific high-value cards, calculated based on sound statistical methods.
- A clear statement that contents are randomized.
C. Prohibition of "Cherry-Picking":
Company Representatives involved in the sorting, handling, or repackaging process are expressly forbidden from removing high-value cards (often referred to as "cherry-picking") for personal gain, resale, or the benefit of specific individuals or preferred clients. All cards must remain within the inventory stream for random distribution.
IV. Customer Relations and Marketing
We build trust through honest communication and a focus on the collector community.
A. Honest and Accurate Advertising:
All advertising, promotional claims, and product descriptions must be truthful and substantiated. We will not engage in deceptive marketing, greenwashing (misleading environmental claims), or use hyperbole that inflates potential value. Claims regarding "guaranteed value" must be based on objective, verifiable market data (e.g., TCGPlayer Market Price averages or current marketplace sold listings averages).
B. Fair Pricing and Value:
Pricing strategies will be transparent and reflect a reasonable balance between business sustainability and providing fair market value of the expected contents to the customer, aiming to keep the hobby accessible.
C. Responsive and Ethical Customer Support:
The Company will maintain clear, accessible, and responsive channels for customer support. All concerns regarding product integrity, fairness, or quality will be addressed promptly, respectfully, and with a commitment to resolving legitimate issues in good faith.
V. Employee Conduct and Reporting
Our employees are expected to uphold these standards in all aspects of their work and personal conduct related to the hobby.
A. Conflicts of Interest:
Company Representatives must avoid situations where their personal interests conflict, or appear to conflict, with the best interests of the Company and its customers. This includes, but is not limited to:
- Using insider knowledge of upcoming releases or specific inventory contents for personal trading advantage.
- Engaging in personal bulk buying/selling that competes with the Company's business operations.
B. Reporting Misconduct (Whistleblower Protection):
We foster a culture where ethical concerns can be raised without fear of retaliation. Employees are encouraged to report any suspected violations of this policy, illegal activity, or unethical behavior to management or the designated ethics officer. Reports can be made anonymously. The Company strictly prohibits any form of retaliation against individuals who report concerns in good faith.
C. Compliance with Laws:
All Company Representatives must comply with all applicable laws, rules, and regulations in the execution of their duties.
VI. Accountability and Review
This policy is a living document that requires active oversight.
A. Management Responsibility:
The management team is responsible for the implementation, training, and oversight of this policy. All staff will receive mandatory ethics training upon hiring and annually thereafter.
B. Regular Review and Updates:
This policy will be reviewed and updated at least annually, or as needed, to address emerging industry challenges, changes in regulations, and feedback from the community.
C. Disciplinary Action:
Violations of this ethics policy are a serious matter. Confirmed breaches will result in disciplinary action, up to and including termination of employment, termination of supplier contracts, and, if necessary, legal action.
VII. Legal Provisions and Disclaimers
A. Disclaimer of Warranty and Liability
The Company makes no representations or warranties of any kind, express or implied, regarding the fairness or specific value of any individual repackaged product beyond the stated odds and objective market averages. Customers purchase products "as is" and "at their own risk" with the understanding that the nature of collecting involves inherent market risk and value fluctuation. The Company shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use our products or website.
B. Right to Modify
The Company reserves the right to amend, update, or modify this Ethics Policy at any time and at its sole discretion. Any changes will be effective immediately upon posting to this website. Users and employees are responsible for regularly reviewing the policy to stay informed of updates.
C. Governing Law and Jurisdiction
This policy and any disputes arising under it will be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. Any legal action or proceeding related to this policy or our business operations shall be brought exclusively in the state or federal courts located in the State of Ohio, and all parties hereby consent to the personal jurisdiction of such courts.
D. Integration
This Ethics Policy is incorporated by reference into the Company’s primary Terms of Service and Privacy Policy, which together constitute the entire agreement between the Company and its customers regarding the subject matter herein.
